Terms of Service

These Terms of Service apply to purchases made through the Namib Chilli online store. By placing an order, you agree to these terms.

Products and availability
We make every effort to ensure that product descriptions, images, ingredients and other information are accurate. As many Namib Chilli products are handcrafted in batches, minor variations in colour, texture or appearance may occur. Products are subject to availability.

Pricing and payment
Prices are displayed in the currency indicated on our website and may change without notice. The price applicable to an order is the price displayed at the time the order is placed. Orders will only be processed once payment has been successfully authorised or received.

Orders
Namib Chilli reserves the right to decline or cancel an order where a product is unavailable, pricing or product information is materially incorrect, payment cannot be confirmed, or we are unable to fulfil the order. If payment has already been received for an order that we cannot fulfil, the applicable amount will be refunded.

Shipping and delivery
Shipping charges, available delivery methods and estimated delivery times will be shown or communicated where applicable. Delivery times are estimates and may be affected by circumstances outside our reasonable control. Please refer to our Shipping Policy for further information.

International orders
International customers are responsible for ensuring that products ordered may legally be imported into their destination country. Customs duties, import taxes, VAT, clearance fees or other destination charges are the customer's responsibility unless expressly stated otherwise at checkout.

Returns and refunds
Returns, damaged products, incorrect orders and refunds are handled in accordance with our Return and Refund Policy.

Food products
Customers are responsible for reviewing product labels, ingredients and allergen information before consumption. Products must be stored and used according to the instructions provided on the packaging.

Liability
To the extent permitted by applicable law, Namib Chilli will not be liable for indirect or consequential losses resulting from the use of our website or products. Nothing in these terms excludes or limits rights or remedies that cannot legally be excluded.

Intellectual property
The Namib Chilli name, branding, product names, logos, photographs, text and other website content may not be reproduced or used for commercial purposes without permission.

Governing law
These Terms of Service are governed by the laws of the Republic of Namibia, subject to any mandatory consumer protection laws that may apply to a customer in another jurisdiction.
